Mr. Hays graduated from the University of Utah (B.S., received his law degree from the University of Virginia J.D., 1995). He has authored numerous articles and book chapters on environmental and commercial litigation including two chapters in The 25 Most Asked Questions About Environmental Law and The Role of State Law in Environmental Litigation. He has also presented numerous lectures on the Endangered Species Act and the role of insurance in environmental litigation. Mr. Hays practices in the areas of construction litigation tort, environmental and natural resources law.

Mr. Hays has litigated numerous business torts, especially claims of intentional interference with contract. His other experience includes:
    • Representing large municipality in Arizona Superior Court trial against manufacturer of runway lighting control system at Phoenix Sky Harbor International Airport.
    • Representing large municipality in lawsuit against construction contractor for defects relating to installation of fueling control system at the Phoenix Sky Harbor International Airport.
    • Representing large municipality in malpractice action against architect of Phoenix Fire Department Operations Center.
    • Representing major league baseball team against requests for equitable adjustment to contract amount brought by prime contractor and its mechanical, electrical, structural steel, and roofing subcontractors relating to construction of the Bank One Ballpark.
    • Representing large municipality in changed site condition claim relating to construction of the Squaw Peak Parkway.
    • Representing large municipality in federal court case concerning stormwater erosion potential stemming from road construction activities.
    • Representing large municipality in lawsuit against prime contractor and product manufacturer for construction defects at wastewater treatment plant.
    • Representing large municipality in fraud case against Phoenix Sky Harbor International Airport sign manufacturer.
    • Representing large municipality in engineer malpractice litigation arising out of Air National Guard refueling center.
